1. INTRODUCTION

The Reparation Hub is a web-based platform that connects the descendants of African enslaved persons with local, national and international businesses and institutions for the purpose of righting a wrong through the Reparation Sponsorship Program (the “Reparation Hub” or “Us” or “We”).

These Terms and Conditions of Use ( the “Terms” ) describe when and the conditions under which you are allowed to access or use the Website.

By using this Website, you acknowledge that you have read and agree to be bound by the Terms. If you do not agree to these Terms, you may not visit, use, or access the Website and may not click to accept the Terms when prompted on the Website.

2. DEFINITIONS

The Reparation Hub has been incorporated in Canada and the Reparation Hub is headquartered in Toronto, Ontario.

Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction.

Sponsor” or “Reparation Sponsor” means individuals, businesses or institutions who have become members of the Reparation Hub for the purpose of sponsoring individuals of African descent via the issuance of a one-time reparation payment or Sponsorship.

Sponsoree” or “Reparation Sponsoree” means individuals of African descent who have become members of the Reparation Hub for the purpose of receiving a reparation payment or Sponsorship.

Sponsorship” means the monetary amount paid by the Sponsor, and received by the Sponsoree after deduction of Reparation Fee, through the Reparation Program on our Website.

User” means any person who accesses, browses, or visits the Website and the term is inclusive of the Sponsor and Sponsoree.

User Content” means any text, image, sound, or any other information submitted or created by the User whilst using the Website.

Website” means https://www.reparationhub.com and all affiliated websites and applications, owned and operated by us, our predecessors or successors in interest, or our Affiliates.

Website Services” means all services that are accessible through the Website, including the Reparation Program.

You” means any person who accesses our Website, including a visitor or User and including any entity or agency on whose behalf any such person accesses or uses our Site.

3. CHANGE IN TERMS

We may change our Terms of Use from time to time. We will notify you if we make any major changes in these terms.

4. LICENSE

We grant you a limited license to access the Website and Website Services. This license is subject to and conditioned on compliance with the Terms.

5. USER OBLIGATIONS

When you post User Content on the Website or through the Website Services or provide Us with User Content, you understand and acknowledge that you are solely responsible for such User Content. Further, you represent and warrant that you have the right, power, and authority to post that User Content.

You acknowledge and agree that the poster of User Content, and not Reparation Hub, is responsible for any User Content including any harms caused to you, another User, or a third party by such User Content.

Reparation Hub is committed to complying with copyright and related laws and requires all Users to comply with these laws. Accordingly, you may not use the Website to store any material or content or disseminate any material or content, in any manner that constitutes an infringement of third-party intellectual property rights, including rights granted by the copyright law.

You may not use, or encourage, promote, facilitate, instruct, or induce others to use, the Website or Website Services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others; or to transmit, store, display, distribute or otherwise make available content that is illegal, fraudulent or harmful to others.

This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

You understand and acknowledge that the Reparation Hub holds the right to deduct fifteen per cent (15%) of the payment from the total Reparation payment granted to a Sponsoree (the “Reparation Fee”).

6. PURPOSE OF THE WEBSITE

The Reparation Hub is aimed towards securing monetary reparation for black people and is the purpose is centred around advocating and securing funds owed to the relatives of African enslaved persons residing in western nations.

The Reparation Hub will not depend upon governments for financial reparation to Black people so that they do not continue to struggle and die in poverty due to systemic anti-black racism government laws and policies.

The Reparation Hub aims to acts as a platform between the Sponsors and the SponsoreeSponsorees to successfully enable the Sponsorees to receive sponsorship (the “Reparation Program”).

7. USE OF IMAGES

Unless otherwise noted, all images (GIF, JPG, PNG, TIFF or other formats) on our website are the copyright of Reparation Hub. Images must not be downloaded, reproduced or retransmitted from this website, and while images may be used for personal use, prior consent must be obtained from the Reparation Hub. You may download one copy of the clothing image for personal use.

8. REPARATION SPONSOREE ACCOUNT

To be able to enrol in the Reparation Program and for being considered for Sponsorship, a User is required to Sign Up as a Reparation Sponsoree on our Website. After successfully signing up as a Reparation Sponsoree, a “Sponsoree Account” will be created.

The details, passwords and other credentials associated with the Sponsoree Account must not be shared or distributed.

Creation of a basic Sponsoree Account is free on our Website. However, the Sponsoree may choose the availability of Featured ads on the profile to increase the visibility and appeal of the profile. If the Sponsoree opts for Featured ads, the Sponsoree would be required to pay Us a fixed monthly rate of $10 (Ten Dollars) (the “Ad Fee”).

Sponsoree and their families are selected for Sponsorship only when they meet certain criteria as described in these Terms (the “Sponsorship Criteria”).

To be eligible for Sponsorship, the Sponsoree will be required to complete a financial course (the “Money Management Course”).

The DNA results along with a photo of Sponsoree’s Identification Card are forwarded to one or more Sponsors after the creation of Sponsoree Account.

In case the Sponsoree or his family are chosen for Sponsorship, he will receive an email notification on the email address provided to us.

On a Sponsoree being successfully granted Sponsorship, the funds will be deposited into the PayPal account of the Sponsoree within a period of two to six weeks.

The Sponsorees may be offered the option to take advantage of opportunities in entrepreneurship that the Reparation Hub has secured specifically for the recipients of Sponsorship.

The Sponsoree may express appreciation by writing a thank you letter to the Reparation Sponsor.

9. QUALIFICATIONS OF A REPARATION SPONSOREE

To Sign up on our Website as a Reparation Sponsoree, the User must possess the following qualifications:

  • The User must have completed at least 18 years of age

  • There must be no outstanding warrants of criminal cases against the User

  • The DNA must be composed as follows:

    • More than 65% DNA to be Sub-Saharan African, or

    • More than 50% DNA to be Sub-Saharan African combined with more than 15% DNA to be Native American

  • The User must be a resident of any one of the following countries:

    • Canada

    • USA

    • The Bahamas

    • Jamaica

    • St. Kitts & Nevis

    • Antigua & Barbuda Dominica

    • St. Lucia Barbados

    • St. Vincent & the Grenadines Grenada

    • Trinidad & Tobago

    • Australia

    • Ireland

    • New Zealand

    • United Kingdom

10. SPONSORSHIP CRITERIA

To be eligible for being considered for Sponsorship, the Sponsoree must fulfil a Sponsorship Criteria which is described here in:

  • The Sponsoree must have undergone a DNA Test and should submit the Results of the said test to Reparation Hub.

  • There must be no criminal Warrants issued against the Sponsoree.

  • The Sponsoree must have been identified by way of Identity Verification conducted by the Reparation Hub.

  • The Sponsoree’s Income and Financial Position must have been verified and ascertained by way of Income Verification conducted by the Reparation Hub.

  • The Sponsoree must have successfully undergone and completed the Money Management Course.

MONEY MANAGEMENT COURSE


It is a third-party money management course comprising of 50 test questions to be attempted by the Sponsoree.

It is a free course was created by the National Endowment for Financial Education - 5 part basic money management course covering topics such as Spending & Saving, Credit & Debt, Insurance, Investing and Employment.

The Reparation Hub neither endorses nor is affiliated with the National Endowment for Financial Education.

The Reparation Hub does not sell the course material provided by the National Endowment for Financial Education but only utilises the contents of the course.

No fee would be charged from the Sponsorees for the Money Management Course.

REPARATION SPONSOR ACCOUNT

To be able to contribute to the Reparation Program by extending Sponsorship, a User is required to Sign Up as a Reparation Sponsor on our Website. After successfully signing up as a Reparation Sponsor, a “Sponsor Account” will be created.

The Sponsor may choose to remain anonymous at the time of the creation of a Sponsor Account.

The Sponsor will be given the option to either sponsor an individual Sponsoree or a family and the reparations fees to be charged from the Sponsor towards Sponsorship will vary according to the option selected by the Sponsor.

The details, passwords and other credentials associated with the Sponsor Account must not be shared or distributed.

By logging into the Sponsor Account, the Sponsor may browse Sponsoree profiles by clicking first on “My Account” and then on “Sponsorship Directory”. Once the Sponsoree selects any Sponsoree profile, he may grant Sponsorship by clicking on the Sponsoree profile and then on “Sponsor”. Once the Sponsor selects the Sponsoree, the former will be able to view the DNA results and photo identification of the Sponsoree.

The Sponsorship amount contributed by the Sponsoree will be transferred to the Sponsoree after deduction of the Reparation Fee.

The Sponsor is entitled to:

  • a receipt of transfer of Sponsorship,

  • Unless the Sponsor had elected to remain anonymous, all the benefits of Reparation Hub Sponsorship Program, and

  • a progress report on the individual or family-sponsored, to be provided after 1 year from the date of Sponsorship.

1. QUALIFICATIONS OF A REPARATION SPONSOR

To Sign up on our Website as a Reparation Sponsoree, the User must possess the following qualifications

  • The User must have completed at least 18 years of age,

  • The User must possess the ability to extend Sponsorship, to one or more Sponsorees, amounting to at least $160,000,000, and

  • The User must confirm his identity to the satisfaction of Reparation Hub.

2. NO GUARANTEE

Getting sponsored can take anywhere from a month to several years to not getting sponsored at all. We are doing our very best to promote our reparation program all over the world. However, we do not guarantee that a Sponsoree will receive Sponsorship.

3. TERMINATION

  • If at any time you decide you can no longer agree to these Terms or any changes made to the Terms, you must immediately stop using the Website.

  • We may immediately end your use of the Website if you break the Terms.

  • We may also withdraw your Sponsoree Account or Sponsor Account created at our Website for any reason, without notice, at any time and without any liability to you.

  • We will not offer you compensation for any losses sustained by you. If your Sponsor Account or Sponsoree Account is deactivated, some of your data may persist and appear within the Website.

INTELLECTUAL PROPERTY

The Reparation Hub and our licensors retain all right, title, and interest in and to all Intellectual Property Rights related in and to the Website and the Website Services.

The Reparation Hub logos, names, trademarks, designs and all other program names, company names, marks, logos, and symbols on the Website or Website Services belong to Us.

Any information or content expressed or made available by a third party or any other Website User is that of the respective author(s) or distributor(s) and not of Reparation Hub. We neither endorse nor are responsible for the accuracy or reliability of any information posted, or statement made on the Website by anyone other than our authorized agents acting in their official capacities.

The Website may contain links to third-party websites. The Website may also contain applications that allow you to access third-party websites via the Website. Such third-party websites or applications are owned and operated by the third parties and/or their licensors. The inclusion of any link or application on the Website does not imply that we endorse the linked site or application. You use the links and third-party websites at your own risk and agree that your use of an application or third-party website accessed via the Website is on an “as is” and “as available” basis without any warranty for any purpose.

2.1. REPORTING AND CORRECTING VIOLATIONS

If you become aware of any violation of these Terms, you must immediately report it to Reparation Hub.

You agree to assist us with any investigation we undertake and to take any remedial steps we require to correct a violation of these Terms.

2.2. LIMITATION OF LIABILITY

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

The website and the service could include technical inaccuracies or typographical errors. We shall have no liability in connection with any such inaccuracies or errors, nor shall we have any obligation to identify and/or correct any such inaccuracies or errors.

We are not responsible or liable for any loss or harm caused by viruses, worms or other such programmes.

We will never be responsible for any loss or damage that is not reasonably foreseeable and we will never be responsible for indirect losses and/or financial and business loss, or loss of goodwill or reputation

2.3. INDEMNIFICATION

You will indemnify, defend, and hold harmless Reparation Hub, our Affiliates, and our respective directors, officers, employees, representatives, and agents (the “Indemnified Party”) from all claims, damages, liabilities, costs, losses, and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) arising from or relating to any claim, suit, proceeding, demand, or action brought by you or a third party or other User against an Indemnified Party relating to or arising out of any User Content you post.

2.4. FORCE MAJEURE

Neither party shall be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to earthquake, flood, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the party shall be entitled to a reasonable extension of its obligations.

DISPUTE RESOLUTION

Any controversy, claim or dispute arising out of, relating to, or in respect of these Terms, including their negotiation, validity, existence, breach, termination, construction or application, or the rights, duties or obligations of any party, or the rights, duties or obligations of any party derived from or associated with these Terms (the “Dispute”), shall be referred to and determined by a single arbitrator in a final and binding arbitration administered by under the rules of ADR Institute of Canada, Inc.’s Arbitration Rules.

If the parties to the arbitration have not agreed upon the arbitrator within 14 days, the parties shall ask the ADR Institute of Canada, Inc. to appoint a single arbitrator.

The seat of the arbitration shall be the same as the provincial or territorial law governing these Terms unless the parties agree otherwise.

The costs and expenses of the arbitrator shall be shared equally between the parties.

A party to the arbitration has no right of appeal from any award of the Arbitrator, whether characterized as final, interim, interlocutory or partial.

All Disputes referred to arbitration (including the scope of the agreement to arbitrate, the law relating to the enforcement of the agreement to arbitrate, any relevant limitation periods, the law governing the procedure of the arbitration, the law relating to available remedies, set-off claims and conflict of laws rules) shall be governed by the law of the seat, and each party hereby irrevocably consents to the venue, and to the jurisdiction of competent courts in the seat for all litigation that may be brought, subject to the requirements for arbitration hereunder, with respect to the terms of, and the transactions and relationships contemplated by, these Terms.

Notwithstanding this provision, a party to these Terms may take such steps as are permitted or required to enforce an award made by an arbitrator.

No document or other evidence or information prepared for or produced by or on behalf of any party to the arbitration shall be disclosed to any non-party to the arbitration. EACH PARTY HEREBY EXPRESSLY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING BROUGHT BY OR AGAINST EITHER PARTY IN CONNECTION WITH THESE TERMS.

You agree that you will not contest venue, and you waive any rights that you may have to initiate, transfer, or change the venue of any litigation arising from or related to these Terms.

1. GOVERNING LAW

The validity, interpretation, construction, and performance of these Terms shall be governed by the laws of Ontario, without giving effect to its principles of conflict of laws.

2. ASSIGNMENT

User shall not assign the Sponsor Account or the Sponsoree account, in whole or in part, to any other person.

User shall not assign any of the rights and obligations under these Terms.

PRIVACY POLICY


The Reparation Hub provides an electronic means for accessing information about our programs and services through this Website. We attempt to keep our Website as current as possible.

We reserve the right to alter our privacy policy as business needs require.

If you visit our sites to browse, read, and/or download information, the User-generated content inclusive of the following information (in addition to other information asked on the Website) may be collected and used:

  • Name of the User

  • Name of your city

  • Photograph

  • Email-address

  • Contact Number

  • Yearly Income

  • DNA Results

If you choose to identify yourself by sending us an email or completing our online forms, we use personally-identifying information to process or respond to your request. If you complete an online form, the information you provide is up to you. However, if you do not provide certain information, such as your name, it may be impossible for us to respond to your request.

We may retain this User-generated content and other information in our files, either in electronic form or hardcopy.

We recommend that you not use email to send us private or sensitive data about yourself or others unless the data is encoded or encrypted.

Right to publish

Reparation Hub reserves the right to publish the User Content including the name, city and photograph of any Reparation SponsoreeSponsoree. This is necessary for us to demonstrate that Sponsoree obtain sponsorship by our Reparation Program.

Reparation Hub reserves the right to publish the User Content generated by the Sponsor unless, at the time of the creation of Sponsor account on the Website, the Sponsor specifically choose for his/her identity to remain anonymous.

Use by children

Users are cautioned that the collection of personal information requested from or volunteered by children on-line or by e-mail will be treated as if the same as information was given by an adult and may be subject to public access.

Your right to know

You have the right to know what data is collected about you and to view all public or private data about yourself at no cost or be charged a reasonable fee for copies.

You have the right to have the meaning of data explained to you in a way you understand.

We will acknowledge and respond to every request it receives for access to collected data appropriately and promptly.

Our websites may contain links to other public or private organizations.
